Your submission of an order indicates that you have fully read and understood the product descriptions and instructions pertaining to the items ordered, as well as your agreement with the following terms of sale, and policies stated in the Shipping Policy, Expedited Services, and Return Policy.
If you are having your order shipped outside the United States, please carefully read the International Delivery page before choosing your shipping method and placing your order.
Please note that dye lots vary on fabrics, so colors may differ slightly in shade from photos. Trims (laces, edge bindings, brush fringe, etc.) may also vary slightly as trim manufacturers often discontinue a style once it sells out. However, the differences will not be so dramatic as to appear to be a different style. We do not recommend splitting components of a single ensemble into separate orders as the fabric lots may change between orders. Also, due to computer monitor settings, colors may also appear slightly different on your computer. While we purchase premium quality materials and components for all our products, natural products such as feathers and plumes may sometimes contain small natural flaws and irregularities.
Proportions of custom items may appear different than items pictured in listings due to your pet or horse’s size and measurements. Due to the individual nature of handcrafted items, finished sizes of certain items may not come to exact measurements (e.g. a 24″ item may come to 23.5″ or 24.25″).
All items of clothing and costumes are used at your own discretion and intended for calm and docile animals. While we try to make all our items comfortable and as safe as possible, it is the user’s responsibility to ensure proper fit and usage. It is also the user’s responsibility to ensure the safety of all persons, animals, and property which may be affected by your use of our products. Do not replace any correctional or safety equipment that your pet requires with clothing or costumes, and supervise children with pets at all times. Because we have no control over the conditions (environment, people, horses, and other animals) in which our products will be used, Franga Designs/If Wishes Were Ponies is not liable for any damages (physical or financial) or injuries to persons, animals or property resulting from or occurring simultaneously with use of our costumes.
Franga Designs/If Wishes Were Ponies provides custom products made to your specifications. We cannot be held responsible for inaccurate measurements or purchases made without measuring the animal for whom the product is intended. We consider horse measurements self-explanatory to anyone with reasonable knowledge of horse anatomy and tack. If you have any questions about sizing and measurements, please contact us for clarification before placing your order.
Our products are individually hand-made with the utmost care and attention. All custom items are checked to correspond with customer specified measurements and/or design selections, inspected for defects and documented with photographs prior to shipping. Due the custom nature of our merchandise (several hours to several days to produce each item), as well as health concerns, all sales are final. While we construct all items to be as sturdy as possible, we provide no guarantees or warranties due to the unpredictable nature of animals and conditions in which the items are used.
If there is an issue with your order (e.g. if you receive the wrong item or size), you agree to contact us to resolve the issue rather than filing a chargeback with your credit card company. We spend a significant amount of time hand-making each order to specification and filing a chargeback and keeping the item(s) constitutes fraud and theft.
If such a fraudulent chargeback is committed after products and services are delivered, the matter will be referred to law enforcement and debt collection agencies. You agree to be responsible for all costs incurred in recovering debt resulting from fraudulent chargebacks.
Any shipping damage must be reported within 2 business days of receipt. Reporting an item as “damaged from shipping” after you have used it will result in the permanent termination of your customer account.
Once an order is placed, it cannot be canceled as it is immediately prepared for production or shipment. A custom order will ship out according to the service option time frame you select when placing your order. It is your responsibility to ensure that the correct custom service option and shipping methods are selected when placing a time-sensitive order. It is also your responsibility to fully read all product descriptions and not rely solely on product photos which sometimes show complementing items and accessories which are sold separately.
High value orders require a signature upon delivery. If you are not present at the time of attempted delivery, it is your responsiblity to pick up your package or schedule a re-delivery. This may be done online at USPS.com. If your package is returned to us as unclaimed, you will be responsible for additional charges to reship your package. Custom items – any items that have made to your specification(s) of size, color, etc. – cannot be returned.
